In this paper, we analyze some of the ethical dimensions of going private transactions (GPTs), wherein publicly traded firms are taken private. Financial theory suggests that efficiencies may be realized in these transactions such that outside shareholders are made better off. Empirical evidence supports this theory. We therefore argue that GPTs are not inherently exploitive or unethical. The issues of the fiduciary duty of corporate managers to shareholders and their obligations to non-shareholders are also explored.

In this commentary, we present two examples where perception is not only influenced by, but also in fact driven by, top-down effects: hallucinations and mental imagery. Crucially, both examples avoid all six of the potential confounds that Firestone & Scholl (F&S) raised as arguments against previous studies claiming to demonstrate the influence of top-down effects on perception.

The binding problem is fundamental to visual perception. It is the problem of associating an object's visual properties with itself and not with some other object. The problem is made particular difficult because different properties of an object, such as its color, shape, size, and motion, are often processed independently, sometimes in different cortical areas. The results of these separate analyses have to be combined before the object can be seen as a single coherent entity as opposed to a collection (...) of unconnected features. Visual bindings are typically initiated and updated in a serial fashion, one object at a time. Here, we show that one type of binding, location-identity bindings, can be updated in parallel. We do this by using two complementary techniques, the simultaneous-sequential paradigm and systems factorial technology. These techniques make different assumptions and rely on different behavioral measures, yet both came to the same conclusion. (shrink)

Nijhawan's theory rests on the assumption that transient signals compete with predictive signals to generate the visual percept. We describe experiments that show that this assumption is incorrect. Our results are consistent with an alternative theory that proposes that vision is instead postdictive, in that the perception of an event is influenced by occurrences after the event.

This study examines the relationship between the ethical behavior and customer orientation of insurance sales agents engaged in the selling of complex services, e.g. health, life, auto, and property insurance. The effect of ethical and customer-oriented behavior, measured by the SOCO scale (Saxe and Weitz, 1982), on the annual premiums generated by the agents is also investigated. Customeroriented sales agents are found to engage in less unethical behavior than their sales-oriented counterparts. Further, sales-oriented agents are found to perceive greater levels (...) of unethical behavior among their significant others. Alarmingly, higher levels of sales premiums are found among those agents who engage in unethical behavior. (shrink)

This paper is a brief reponse to some of Douglas Portmore's criticisms of our version of the agent-relative/agent-neutral distinction.

In this paper, I criticize David McNaughton and Piers Rawling's formalization of the agent-relative/agent-neutral distinction. I argue that their formalization is unable to accommodate an important ethical distinction between two types of conditional obligations. I then suggest a way of revising their formalization so as to fix the problem.

This article offers a qualified defence of the view that there is a moral difference between telling lies to one's patients, and deceiving them without lying. However, I take issue with certain arguments offered by Jennifer Jackson in support of the same conclusion. In particular, I challenge her claim that to deny that there is such a moral difference makes sense only within a utilitarian framework, and I cast doubt on the aptness of some of her examples of non-lying deception. But I argue that lies have a greater tendency to damage trust than does non-lying deception, and suggest that since many doctors do believe there is a moral boundary between the two types of deception, encouraging them to violate that boundary may have adverse general effects on their moral sensibilities. According to commitment accounts of assertion, asserting is committing oneself to something’s being the case, where such commitment is understood in terms of norms governing a social practice. I elaborate and compare two version of such accounts, liability accounts (associated with C.S. Peirce) and dialectical norm accounts (associated with Robert Brandom), concluding that the latter are more defensible. I argue that both versions of commitment account possess a potential advantage over rival normative accounts of assertion in that they needn’t presuppose (...) any notion of an assertion’s correctness. Additionally, I show how dialectical norm accounts can explain relations between assertion and truth. After setting forth objections that have been raised against commitment accounts, I argue that responses are available on behalf of dialectical norm accounts. Finally, I propose that a liberalized dialectical norm account can illuminate phenomena sometimes seen as supporting truth relativism. (shrink)

Standard defences of preservationism, and of the intrinsic value of nature more generally, are vulnerable to at least three objections. The first of these comes from social constructivism, the second from the claim that it is incoherent to argue that nature is both 'other' and something with which we can feel unity, whilst the third links defences of nature to authoritarian objectivism and dangerously misanthropic normative dichotomies which set pure nature against impure humanity. I argue that all these objections may (...) be answered by recasting the relationship between man and nature into a tripartite spectrum of ontological form between nature and artifact, with the key question being the extent to which nature has been humanised in accordance with certain modes of strongly instrumental rationality, these in turn being defined by reference to the split between abstract reason and natural feeling which was exacerbated by specific elements in the Enlightenment period. This new model may grant normative force by linking external nature to a broader conception of human psychological wellbeing than that offered by the quantitatively orientated models of human rationality and agency. This paper is an examination of the concept of recognition and its connection with identity and respect. This is related to the question of how women are or are not adequately recognised or respected for their achievements in sport and whether eliminating sex segregation in sport is a solution. This will require an analysis of the concept of excellence in sport, as well as the relationship between fairness and inclusion in an activity that is fundamentally about bodily movement. I argue (...) that attempts to address the problem of women’s recognition in sport need to do so in ways that neither eliminate sport as a fairness regulated system for developing individual excellence in bodily movement nor that prevent women’s achievement of sporting excellence, with the regard that belongs to them. Doing this requires us to decide whether sport is about champions or about individual excellence. (shrink)

William James’s radical empiricism and pragmatism constitutes a philosophy that can reconcile the split between intrinsic value theorists, who stress the development and relevance of theoretical axiology, and pragmatists who have favored a more direct emphasis on environmental policy and application. By distinguishing James’s emphasis on direct personal experience from John Dewey’s more socialized approach, James’s distinctive emphasis on the transformative possibilities of pure experience and his links to romantic sensibility enable us to articulate and validate the noninstrumental aspects of (...) experienced environmental values that anti-pragmatists habitually regard pragmatism as unable to speak for. Using James’s framework to explicate and support Anthony Weston’s radically noninstrumental “immediate values” better expresses the felt noninstrumental worth of nature than intrinsic value theory can. Nonetheless, a rapprochement between the two sides is possible: although James’s pragmatic naturalism is the framework that can best capture nature’s experienced noninstrumental worth and link it to wider human values, intrinsic value theory has real practical application in the realm of law, and pragmatists can support it in that domain, thus upholding the primary emphasis on practicality and policy that is usually seen as pragmatism’s main strength. This paper addresses two issues: the controversy over pragmatism in environmental philosophy, and the habitual exclusion of William James's work from serious examination. Addressing critiques of pragmatic naturalism from Max Horkheimer, Eugene Hargrove and Holmes Rolston, I argue that their criticisms misfire, primarily due to skewed perception derived from mis-interpretative projections of views to which pragmatism is not committed. I conclude that the critics' major concerns are largely groundless, but that greater emphasis on pragmatism's experiential aspect would clarify this.

A leading classical utilitarian, John Stuart Mill is an unlikely contributor to the public reason tradition in political philosophy. To hold that social rules or political institutions are justified by their contribution to overall happiness is to deny that they are justified by their being the object of consensus or convergence among all those holding qualified moral or political viewpoints. In this chapter, I explore the surprising ways in which Mill nevertheless works to accommodate the problems and insights of the (...) public reason tradition, and the extent to which he makes arguments that can help those working within that tradition. Mill’s utilitarian theory incorporates the claim that the demands of social life require a publicly accepted set of normative expectations to govern judgments about when one has met one’s obligations and, relatedly, about the appropriateness of blame or punishment. We investigated the causes and impact of procrastination on “slippery deadlines,” where the due date is ill-defined and can be autonomously extended, using the unique applied setting of grievance arbitration across two studies. In Study One, using 3 years of observed performance data derived from Canadian arbitration cases and a survey of leading arbitrators, we examined the effect of individual differences, self-regulatory skills, workloads and task characteristics on time delay. Observed delay here is a critical criterion, where justice is emphasized (...) to be swift and sure. Multilevel Modeling established trait procrastination as a substantive predictor of observed delay, equivalent to the environmental contributors of expediting the arbitration procedure or grievance complexity. Also, despite substantive negative consequence of delay for both arbitrators and their clients, arbitrators who scored one standard deviation above the mean in procrastination took approximately 83 days to write their decisions compared to the 26 days for arbitrators one standard deviation below the mean. In Study Two, we conducted a replication and extension survey with a much larger group of American arbitrators. Consistent with Temporal Motivation Theory, trait procrastination was largely explained by expectancy, value, and sensitivity to time related traits and skills, which together accounted for majority of the variance in trait procrastination, leaving little left for other explanations. For example, perfectionism connection to procrastination appears to be distal, being largely mediated by each of TMT’s core variables. Finally, procrastination was largely synonymous with a deadline pacing style, indicating that observed delay can be used as a proxy for procrastination as long as little or no prior work was done. In all, our results indicate that procrastination is rampant in the workplace and has seriously detrimental effects. (shrink)

Building on recent work, I present sequent systems for the non-classical logics LP, K3, and FDE with two main virtues. First, derivations closely resemble those in standard Gentzen-style systems. Second, the systems can be obtained by reformulating a classical system using nonstandard sequent structure and simply removing certain structural rules (relatives of exchange and contraction). I clarify two senses in which these logics count as “substructural.”.

I suggest that we may want to strive, over time, to change our present professional-cultural view, from one that sees an expression of moral distress as a threat, to a professional-cultural view that welcomes these challenges. Such an effort to better medicine would not only include dissenting clinicians, but patients (and their loved ones) as well.

Donald Davidson is famous for, among other things, his theory of radical interpretation – an account of how it is that we can attribute meanings to people's words, and contents to their mental states, based on an apparent paucity of evidence. This account is infused with ideas from, and applications of, the general theory of measurement, as well as one specific instance of that theory – decision theory. In addition, however, Davidson also applies measurement theory – in the form of (...) his “measurement theoretic analogy” – from outside the theory of radical interpretation, to yield a novel account of one of its notable features: the indeterminacy of interpretation. I argue that the success of this application is limited, however, in dispelling a worry to which indeterminacy gives rise – namely that if Davidson's account of indeterminacy is correct, we have no mental states. My aim in this chapter is to place John Stuart Mill’s distinctive utilitarian political philosophy in the context of the debate about luck, responsibility, and equality. I hope it will reveal the extent to which his utilitarianism provides a helpful framework for synthesizing the competing claims of luck and relational egalitarianism. I attempt to show that when Mill’s distributive justice commitments are not decided by direct appeal to overall happiness, they are guided by three main public principles: an impartiality principle, (...) a sufficiency principle, and a merit principle. The question then becomes how luck and relational considerations figure into his articulation of these public principles. I argue that relational egalitarianism is more fundamental than considerations of luck and responsibility in Mill’s thought, but I also hope to show that any fleshed out picture of Mill’s reform proposals must recognize his condemnation of the role luck plays in determining the distribution of opportunities and outcomes. Ever since the resurrection of interest (...) in pragmatism in the late twentieth century, we have seen a range of publications offering new interpretations for the ideas of the classical pragmatists, as well as important new applications for philosophical pragmatism and the moving to center stage of historically sidelined individuals and groups. What we have seen relatively little of, however, aside from a 2016 symposium in the European Journal of Pragmatism and American Philosophy, is sustained engagement with the question of what a classically pragmatist approach to historical inquiry might contribute, entail, or imply. It is this important niche in the ecosystem of American philosophy that Marnie Binder's A Pragmatist Philosophy of History seeks to partially fill in.Binder, who is perhaps best known for her past writings on José Ortega y Gasset, is at pains from the start to indicate both the humility and the utility of her project. As befits the tradition, there are no grandiose philosophical pretensions here, with the "goal in presenting a pragmatist philosophy of [End Page 112] history" merely being "to add another apparatus to the toolkits of the philosopher and the historian," an extra perspective that is "meant to complement other methodologies" (xi; emphasis in original), as she explains in her introduction. At the same time, pragmatism can offer something distinctive, firstly through asking the pragmatic question of what difference is meant by the accepting of particular presumed facts as being true, and secondly, being able to better understand why certain historical details have relevance, value, and meaning for us as a result of answering the first question. A pragmatist philosophy of history is helpful then, Binder maintains, as it "is in a unique position to bridge the speculative analytic divide" (xiii), and her approach to doing this is to draw upon the resources found in the works of a succession of the familiar classical pragmatists, building toward a synthesis and a cashing out of insights in her concluding reflections.Structurally the work consists of an explanatory introduction followed by six chapters, each dedicated to a particular pragmatist and their insights, leading finally to an extended concluding section drawing the component parts together and answering possible objections to the project. Pragmatism, as Binder recognizes, is seldom thought of as a historically orientated philosophy, but she argues that for each of these thinkers—William James, John Dewey, F. C. S. Schiller, Charles Sanders Peirce, George Herbert Mead, and Jane Addams—there is at least the germ of a philosophy of history that can be unearthed and developed, eventually helping to inform understanding of what is needed to bring a pragmatist ethics into practical reality, the last of which is manifested primarily by Addams. Thus, the treatment of William James in chapter 1 homes in on James's psychological insights into the way that experienced reality forms a temporal continuum; our consciousness necessarily selects from the experiences of the past, ascribing interpretations and assuming levels of facticity and relevance, since no individual can know all the facts or select among them with perfect impartiality. The continuum will be one that speaks to the inquirer's concerns with accuracy, practicality, meaningfulness, and coherence, as all knowledge comes about through temporal processes, and since past events are continuously added to and can be continuously reinterpreted, it can have no real or ultimate beginning or end. By the turn of the nineteenth century, Jeremy Bentham was a well‐ known moral and legal reformer. Bentham's moral philosophy is often introduced as an object lesson in the failures of simplistic utilitarianism. This chapter outlines the basic elements of Bentham's political philosophy. It looks at three important and distinctive features of his utilitarian thought: his introduction of four subordinate ends to guide public morality and law, his account of “official aptitude,” and his “assumption of infallibility” argument. The chapter then (...) considers James Mill's own published comments, positive and negative, on Bentham's work. It argues that, despite some rhetorical flourishes, Mill's critical comments are carefully qualified and quite specific, and do not touch large parts of Bentham's utilitarian reform project. The chapter then articulates what Mill in fact carries over from Bentham, revealing the continuing significance of both these great utilitarian thinkers. (shrink)

This article is part of a symposium on Bruce Cain's "Democracy More or Less: America’s Political Reform Quandary." It identifies the basic normative framework of Cain's skeptical "reform pluralism" as a form of democratic instrumentalism rather than political realism, and then argues that a more optimistic instrumentalist alternative is available. The instrumentalist can accept that more democracy need not entail better democracy. But the instrumentalist account of better democracy also gives us reason to believe that significant reform efforts remain worth (...) pursuing, for the simple reason that some of them have worked in the past. Shared decision making (SDM) is the state of the art for clinicians’ communication with patients and surrogate decision makers. SDM involves give and take, in which all parties interact to maximize the autonomy of patients. In this article I summarize the core steps of SDM and explore ways to use it to benefit patients to the greatest extent. I review three articles included in this issue of The Journal of Clinical Ethics that highlight additional approaches we can use to help (...) patients and parents to see what may be in their own or their child’s best interest. I describe how these approaches can be used in most other medical fields. I explore ways to share information with patients that are outside the usual scope of SDM. Finally, I discuss how we might look, together with patients, at what all parties are feeling before we begin the process of SDM. (shrink)

In this chapter, I examine the three main arguments of On Liberty: first, a largely epistemic argument that individual and social improvement, because they depend so much on intellectual development, require social conditions allowing for free discussion and “experiments of living;” second, an argument that individuality, or self‐directedness, is itself a key constitutive part of the individual human good; third, the introduction of a principle – the liberty principle – according to which only considerations of nonconsensual “harm to others” may (...) justify social or political interference.
